Yesterday I found out that the reason we don't have the Hyabusa figures anymore, is because they were a one time crossover between Bungie and some Japanese anime or something.
Search up Ryu Hyabusa, it clears up a lot of things.
In conclusion, Bungie never owned the rights to the Hyabusa and neither did Microsoft, which is why 343i can't use it.

Honestly, I am not very interested in the idea in a Warden Eternal set. If MCX makes it, I'm sure somebody will buy it, but it doesn't really interest me.
